In Hong Kong, an assignment of a registered trademark or a trademark application is a registrable transaction (sections 29(2)(a) and 31). Until particulars of an assignment are filed for registration, the assignment is ineffective as against a person acquiring a conflicting interest without knowledge of it (sections 29(3)(a) and 31(3)).

If the application for registration or the notice to register particulars is signed by or on behalf of the assignor, no assignment document is necessary to register the assignment. However, if the application or notice is not signed by the assignor, a copy of the assignment has to be filed and will be open to public inspection.

If you want to assign your trademarks to another legal entity, you can request for recordal by sending us the following information:

• The assignee's name and address
• The date of assignment
• The assignment of any right
• Copy of the trademark certificate

Time required: 14 working days upon filing

Please note that Hong Kong Trademarks Registry will only process the recordal of assignment but not the assignment documents.
