Trademark Registration in Singapore

The Trade Marks Act (2005 Revised Ed) (Cap. 332), together with its subsidiary legislation which consists of the Trade Marks Rules and Trade Marks (International Registration) Rules, form the legislation governing the registration of trade marks in Singapore. You should file trademark application with the Intellectual Property Office of Singapore to protect your trademark.

A straightforward trademark application should mature within 6 to 9 months as pledged by the Intellectual Property Office of Singapore.

To proceed the trademark application for registration in Singapore, no power of attorney nor legalization of documents is required. However, please furnish us with the following information:

Search

To ensure that the proposed mark is not identical or similar to prior marks in the register, it is advisable to conduct a search of the existing trade marks in the records maintained by the Registry of Trade Marks.

Procedure

When we have received your application, we will issue a confirmation letter which summarizes the details and specification of the application for your final checking. Please confirm the application by signing on the letter and return to us by fax or email. The application will be filed within 5 working days of receiving the signed confirmation letter, and we will report the filing with a copy of the official filing receipt. You can check the existence of the received application through the Intellectual Property Office of Singaporeˇ¦s internet search system website http://tmsearch.ipos.gov.sg.

There are 6 stages in the process of examining an application for registration:

If the application is procedurally in order and does not face any objections and opposition in the 3 months publication period, the application will be accepted for registration within 4 to 6 months of his application as pledged by the Intellectual Property Office of Singapore.

However, if the application cannot pass the formalities and search examination and is rejected by the Trade Marks Registry of Singapore, the application in such situation will take more than 6 months as discussing these objections and counter objections will take considerable time. Otherwise, you may abandon the pending application at no extra-cost.

Validity period of registration

Upon registration, a trademark will last for a period of 10 years dating back to the filing date and can be renewed indefinitely for successive periods of 10 years.

Convention Priority

If you have a corresponding application filed earlier in a Paris Convention country or a World Trade Organization member country, you may claim priority from this first-filed application, provided the Singapore registration is filed within six months from the date of the first filing. When a priority is claimed, the filing date in Singapore dates back to the date of the first filing. It is possible to claim priority from more than one priority application, or for some but not all the goods or services in the priority application. Priority documents and translations (if applicable) will only need to be furnished if it is requested for by the Registry of Trade Marks.
