The Trademark Act B.E. 2534 provides trademark protection in Thailand. It is important to register your mark in Thailand if you intend to expand your business there as Thailand does not have any international agreements on trademark ownership and thus unregistered mark is in danger of being claimed by another party. To obtain a protection of trademark in Thailand, a registration of trademark must be obtained from the Department of Intellectual Property (DIP) initiated by filing application with the Trademark Office, based on ˇ§first-to-file systemˇ¨.
The process takes approximately 6 months to one year from the date of filing. However trademark protection begins on the day the application is filed.

To proceed the trademark application for registration in Thailand, please provide the following information:
Search
Pre-filing search is useful in determining if a trademark of a similar style or design exists especially in preventing possible delays and complications. The applicant may make necessary adjustments to the trademark before beginning the registration process.
Procedure
When we have received your application, we will issue a confirmation letter which summarizes the details and specification of the application for your final checking. Please confirm the application by signing on the letter and return to us by fax or email. The application will be filed within 5 working days of receiving the signed confirmation letter, and we will report the filing with a copy of the official filing receipt.
After the application is filed, the Trademark Registrar would examine the application in 6-8 months. The Trademark Registrar would have examination on formality and distinctiveness of the mark; the Registrar also examine whether the trademark is similar to prior registered trademark and as to whether the trademark is contradict to the provision for registration or not and issue official notice of instruction, if any.
If the application has passed the above examination and no official instruction has been issued and provided that no opposition to the trademark arises within 90 days of its publication in the official journal, the Trademark Registrar will grant a trademark registration. Totally, it takes approximately one year. However, in case of objection or other complications, the application may take up to two years.
Validity period of registration
Trademarks registration is valid for 10 years from the date of application and may be renewed every 10 years.
Priority
In case where the application was filed aboard, it is possible for the applicant to claim the priority of the basic application provided that the application filed in Thailand within 6 (six) months as from the first trademark application filing date.
