Trademark Registration in Vietnam

The trademark system of Vietnam is based on Intellectual Property Law 2005. In order to obtain trademark protection in Vietnam, you should file the application with The National Office for Industrial Property (ˇ§NOIPˇ¨). The first to file rule is applied in Vietnam.

The process takes approximately 6 months to one year from the date of filing. However trademark protection begins on the day the application is filed.

To proceed the trademark application for registration in Vietnam, please provide the following information:

Search

Searches are conducted by the Trademark Office of NOIP and cover registrations and pending applications, both national and international under Madrid Agreement with extension to Vietnam. Search reports can be delivered within 10 days. Although they might not be exhaustive, the searches are useful for deciding registration strategies.

Procedure

When we have received your application, we will issue a confirmation letter which summarizes the details and specification of the application for your final checking. Please confirm the application by signing on the letter and return to us by fax or email. The application will be filed within 5 working days of receiving the signed confirmation letter, and we will report the filing with a copy of the official filing receipt.

There are 5 stages in the process of examining an application for registration:

Duration of examination as to form is 3 months from the date of receiving application. After the trademark application is accepted as to form, the application is examined for registrability. The NOIP determines whether the mark is available for use or whether it conflicts with a prior right. Duration of examination as to substance is 9 months from the date of Notice of official acceptance of application as to form. If the mark is accepted, a Certificate of Trademark Registration is granted and a notice of registration is published in the Official Gazette of Industrial Property. If there are no opposition from third parties during the advertisement period, the application will proceed to registration.

Validity period of registration

The validity term of a Trademark Registration Certificate is 10 years from the regular filing date and can then be renewed indefinitely for consecutive periods of 10 years.

Priority

If you wish to claim a priority, please provide a statement of country, application number, filing date of the original foreign application and the certified priority document with an English translation from which the priority is claimed. Paris Convention priority may be claimed if the application is filed within six months of the first application file date.
